Information on the processing of personal data

Pursuant to art. 13 of Regulation (EU) 2016/679 (GDPR or in English meaning GDPR (General Data Protection Regulation ) on the protection of personal data and in relation to your personal data, their processing will be based by [ data controller] on the principles of correctness, lawfulness and transparency, as well as protection of your privacy and protection of your rights. In relation to this, we inform you of the following.

b) Purpose and legal basis of the processing

The processing of your personal data, collected at the time of registration on our websites attributable exclusively to the domain www.tooscanswineacademy.it (hereinafter the “Site”) or at the time of making online purchases on that website, will be carried out for the purposes indicated below.

The legal basis for processing personal data relating to each purpose is specified next to each. When consent is indicated as the legal basis for processing, it is understood that the data will be processed by the Data Controller for such purposes only after obtaining your consent (as the “interested party”).

5. Sending, exclusively to the email address provided by you during the purchase of a service or a service from the Websites, promotional messages on goods or services similar to those purchased by you, unless you object to the processing using the methods indicated below, as provided for by Art. 130, paragraph 4, of Legislative Decree 196/2003 and subsequent amendments and additions – so-called soft spam – (Legal basis for processing: Legitimate interest);

6. To allow navigation on the Websites (Legal basis for processing: legitimate interest).

c) Option or obligation to provide data and consequences of failure to provide data

For all purposes, the provision of personal data is not mandatory. However, it is necessary to register and make purchases on the Sites. Providing data in the fields marked with an asterisk is compulsory; failure to enter them will not allow the registration procedure to be completed. On the other hand, the release of data in the fields not marked with an asterisk, although it may be useful to facilitate relations with us, is optional, and failure to indicate them does not affect the completion of the procedure.

d) Recipients or categories of recipients of personal data

The personal data relating to the processing in question, for the purposes set out above, may be communicated:

– To those within the Data Controller’s organisation who need them due to their role. These individuals are the persons authorised to process under the direct authority of the Data Controller according to Art. 4 no. 10 of EU Regulation 2016/679 (hereinafter “persons in charge”);

– To subjects whose activity is necessary for the execution of the contracts to which you are a party or to fulfil specific requests (e.g.: Carriers, Suppliers of goods and services and Subcontractors both national and foreign within the European Union, Companies and institutions in the banking, credit and insurance sector, Factoring companies, Financial intermediaries, Companies that provide commercial information, Mail delivery companies);

– to third parties to whom the Data Controller may outsource certain activities and who consequently provide the undersigned with certain instrumental services, in any case, related to the processing and purposes described above, such as administrative, accounting, tax, auditing, information system management, credit collection, mass storage, call centre services. These third parties carry out processing on behalf of the Data Controller and are authorised to process them as Data Processors in accordance with the provisions of Art. 28 of the GDPR.

e) Retention period

The owner will retain the personal registration data and accounting data relating to purchases for 10 years from the last use. For marketing and profiling purposes, the purchase data by customers and the personal and contact data of customers and potential customers relating to Promotions will be retained for 24 months and 12 months, respectively.

f) Your rights

At any time, you may exercise, according to Articles 15 to 22 of EU Regulation no. 2016/679, the right to:

a) Ask for confirmation of the existence or otherwise of your data;

b) Obtain information on the purposes of the processing, the categories of personal data, the recipients or categories of recipients to whom the personal data have been or will be communicated and the period or criterion of conservation;

c) Obtain the rectification and deletion of data;

d) Obtain the limitation of the processing;

e) Obtain data portability, i.e. receive them from a data controller, in a structured, commonly used and machine-readable format and transmit them to another data controller without hindrance;

f) Oppose the processing of your personal data at any time (art. 21). In particular, you may oppose the processing of your data for the purpose referred to in point ” c n.5 ” ( so-called soft spam) by accessing your “Reserved Area” or by selecting the link present in each email sent by the Data Controller.

This will make it impossible for the Data Controller to send you communications to promote the direct sale of services or services similar to those previously purchased by you (so-called soft spamming).

g) Oppose an automated decision-making process, including profiling (art.22 );

h) withdraw consent at any time without prejudice to the lawfulness of the processing based on the consent given before the withdrawal;

i) Lodge a complaint with the Data Protection Authority (art.77) if you believe that the processing of your data is contrary to the legislation in force.
